Terms and Conditions for the “Ai Artist Search Contest”
- Organizer:
The competition is organized by Smopp Records UG (limited liability), Bonner Str. 324, 50968 Cologne, Germany, e-mail: info@smopp.ai
- Eligibility to participate:
Natural persons who have reached the age of 18 and fulfil the participation requirements are eligible to participate. Employees of the organizer and their direct relatives are excluded from participation. Participation is open worldwide unless prohibited by local laws.
- Participation Requirements
- Music: Eligible submission are self-produced songs that have been created with the involvement of Artificial Intelligence (AI).
Participants must submit a minimum of five songs (via link), including the musical genre. All submitted songs must be unreleased, meaning they have not been commercially released or made available on any streaming platforms (e.g. Spotify, YouTube, SoundCloud). - Artist Profile: Participants must submit an AI artist profile – for example, a fictional biography, a stylistic self-description, or a conceptual artist persona.
- Socials: At least one active social media profile (via link) must be provided on which the participating person presents themselves as an AI artist.
- Visual: At least one visual submission (e.g. cover artwork, video, etc.; via link) is required. It should support the overall artisitic appearance of the AI artist and must also be generated using AI.
- Participant Information: A valid email address and the participant’s full legal name must be provided.
- Submission:
Submissions must be made digitally via the application form. All required materials must be received by August 8th 2025, 11:59pm.
- Rights and Obligations of Participants:
- The submitted works must be original productions created by the participants themselves using AI.
- No third-party rights (especially copyrights, trademark, or personality rights) may be infringed. Participants assure that they hold all necessary rights to the submitted materials.
- Participants are liable for the completeness and accuracy of their entries and indemnify the organizer against any third-party claims arising in connection with the submitted works.
- Copyright and Usage Rights:
- Participants retain all copyright to their works.
- By submitting their work, participants grant the organizer a free of charge, non-exclusive, temporally and spatially unlimited right to use the submitted works for the following purposes:
- Publication on the website and social media
- Presentation within the framework of the competition (online/offline)
- Public performance and streaming
- Promotion
- Any commercial use requires separate written consent.
- Evaluation and Prizes:
- Participations will be evaluated by a jury of experts according to criteria such as originality, sound quality, and creativity. The jury’s decision is final and not subject to appeal. The winner will be notified by e-mail no later than September 1st 2025, 11:59pm.
- The prize is non-transferable and will not be paid out in cash.
- Data Protection:
Personal data collected as part of the competition will be used exclusively to run the competition and will not be passed on to third parties, except to service providers commissioned to support and run the competition. The provisions of the GDPR apply. Further information can be found in the privacy policy.
- Disclaimer and Reservations:
- The organizer is only liable for damages caused by intent or gross negligence, or in the event of a breach of essential contractual obligations (cardinal obligations). In the case of minor negligence of such obligations, liability shall be limited to foreseeable, typical damages. Any further liability — in particularly for loss of profit, production downtime, or indirect damages—is excluded.
- The organizer is not liable for technical malfunctions, server failures, data loss, or incorrect transmissions. The organizer is also not liable for any legal violations caused by the submitted works.
- The organizer reserves the right to cancel or terminate the competition at any time without prior notice, particularly in cases of force majeure, technical problems, or legal issues. No claims can be made by participants in such cases.
- Final Provisions:
- By participating, the participant agrees to these terms and conditions and to the exclusion of legal recourse. This does not apply to claims arising from injury to life, body, or health, or from mandatory legal provisions.
- The organizer reserves the right to amend these terms and conditions at any time. If any provision is found to be invalid or unenforceable, the validity of the remaining provisions shall not be affected. German law applies.
